NEW DELHI: The Supreme Court on Wednesday had permitted ex-ministers Anil Deshmukh and Nawab Malik, both in judicial custody on laundering charges, to vote in the floor test in Maharashtra assembly that was scheduled for Thursday. However, the CM quit on Wednesday night deciding not to go in for a confidence vote.
A bench of Justices Surya Kant and J B Pardiwala had directed the CBI/ED to escort the duo from jail to the assembly and lodge them back in judicial custody after they cast their votes.
On June 20, the SC had refused their eleventh hour request for permission to go from jail to the House to vote in the MLC polls saying the Representation of People Act did not permit an undertrial to cast his vote. Though on June 20 the bench headed by Justice C T Ravikumar had rejected their plea, it had acceded to the request of advocate Meenakshi Arora, who appeared for both former ministers, that the SC should consider whether some exception could be provided through judicial interpretation to permit jailed MLAs and MPs to vote in elections to Rajya Sabha and legislative councils. It had issued notice to the Centre on this issue. TNN
